1. Agreement to Terms
PrepurchaseKenya is a professional vehicle inspection brand owned and operated by Konye Consultants.
By accessing or using PrepurchaseKenya's platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Service Description
PrepurchaseKenya provides a DIY vehicle inspection platform that allows users to:
- Create and store vehicle inspection data
- Upload and store inspection photos in the cloud
- Generate professional PDF inspection reports
- Access inspection history from any device
3. Account Registration
To use our Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Credits and Payments
4.1 Free Credits
New users can view a sample report upon registration to understand our detailed inspection system. Credits can be purchased to generate your own inspection reports.
4.2 Purchasing Credits
- Additional credits can be purchased via our integrated M-Pesa gateway or by contacting our team.
- Payment Reflection: All payments made to PrepurchaseKenya will reflect as "Konye Consultants" on your mobile money or bank statements.
- Pricing: KES 1,000 per credit (minimum 5 credits) or KES 900 per credit (bulk: minimum 20 credits)
- Payment must be completed before credits are added to your account
- Credits are non-refundable once purchased
- Credits never expire
4.3 Credit Usage
- One credit is deducted when you generate a new inspection report
- Re-downloading existing reports is free and unlimited
- Credits are deducted immediately upon report generation
- No refunds for used credits
5. User Responsibilities
You agree to:
- Use the Service only for lawful purposes
- Provide accurate inspection information
- Not upload malicious content or viruses
- Not attempt to hack or compromise the Service
- Not share copyrighted material without permission
- Not impersonate others or create fake accounts
- Respect intellectual property rights
6. Important Disclaimer

PrepurchaseKenya provides a TOOL for documenting vehicle inspections. We do NOT:
- Provide professional mechanical inspection services
- Guarantee the accuracy of user-entered inspection data
- Certify or validate vehicle condition
- Assume liability for vehicle purchase decisions
- Warrant that inspections will reveal all vehicle defects
Users are responsible for:
- The accuracy of their inspection data and ratings
- Seeking professional mechanical inspection when needed
- Making informed vehicle purchase decisions
- Verifying vehicle history and documentation independently
Our reports are documentation tools only and should not replace professional mechanical inspections for high-value purchases or when significant defects are suspected.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PrepurchaseKenya SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Vehicle purchase decisions made based on inspection reports
- Undiscovered vehicle defects or problems
- Third-party service interruptions (Cloudinary, MongoDB, etc.)
- Data loss due to user error or technical issues
Our total liability to you for any claims shall not exceed the amount you paid for credits in the 12 months preceding the claim.
8. Intellectual Property
8.1 Our Property
The Service, including its design, code, features, and content, is owned by Konye Consultants (trading as PrepurchaseKenya) and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain ownership of your inspection data and photos. By using our Service, you grant us a license to store, process, and display your content solely for providing the Service to you.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in that policy.
10. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We may:
- Perform maintenance that temporarily interrupts service
- Modify or discontinue features with notice
- Suspend service for security or legal reasons
11. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse or misuse the Service
- Fail to pay for purchased credits
You may terminate your account at any time by contacting us. Upon termination, your access to the Service will cease, but these Terms will continue to apply to past use.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notice. Continued use of the Service after changes constitutes acceptance of the modified Terms.
